  • The protections of the employment laws apply even if you are undocumented.
  • It is illegal for your employer to pay you less than the minimum wage (in NYC: $13.50 if you work at a fast food restaurant; $13/hr if there are more than 10 employees in your workplace; $12.00 if 10 or less employees) or required overtime pay (1 ½ times your regular hourly rate for all hours you work more than 40 in a week).
  • The New York City Human Rights Law provides extra protections for pregnant workers – including requiring your employer to provide you reasonable breaks, assist you with physically demanding work, adjust your schedule, provide time off to recover from childbirth, and provide a private space to express breast milk.
